Abstract:
There has been considerable public interest in how the NRA undertakes one of its prime functions, discharge control, and in particular, how the NRA interprets its duties and exercises its powers in respect of discharge consents. It is opportune, in the build up to the proposed Environment Agency, that the NRA should explain how it addresses this vitally important component of water quality management. This is set out in the report. The report is intended to provide an introduction for the non specialist, covering the evolving legal framework within which the NRA exercises its discharge control powers, the consent setting process, and the results of consent monitoring and enforcement. Effective control of discharges to water, through the issue, monitoring and enforcement of consents, is fundamental to the NRA achieving its mission of protecting and improving the water environment in England and Wales.
